Neil Gorsuch, currently a member of the Tenth Circuit Court of Appeals, has been involved in over 20 cases involving ERISA over the past ten years. The rulings he wrote or joined in those cases were mostly about issues such as ERISA preemption of state laws, denial of claims, and cash-balance plans, so his perspective on company stock in ERISA plans is not known.
